ICE is now in the Bay Area.

For all immigrants here, documented or not, here are some tips:

  • Have contact information for a trusted immigration attorney or legal aid program. Consider making a “family emergency plan” (who to call, what to do if someone is detained).
  • Don’t open your door to immigration agents at home or at the office unless they show a valid judicial search warrant, which means it must be signed by a judge, not an ICE officer. If they say they have a warrant ask them to slip it under the door for your review.
  • Don’t sign anything or consent to anything (search of your belongings, your home, etc.) without consulting a lawyer. Some documents may waive rights.
  • You are not required to answer questions from ICE officers about your immigration status, country of origin, or how you entered the United States. If approached, calmly state, “I am exercising my right to remain silent,” and avoid providing unnecessary information that could be used against you.
  • If you are documented, the law states that individuals over 18 should carry immigration documents, such as a green card or proof of status (I-797, I-94). If you do not have your documents, exercise your right to remain silent and avoid signing anything without consulting an attorney.
  • If you’re stopped in public, you can ask if you are being detained. If you are free, you can leave. If you’re not, continue to remain silent and request a lawyer.
  • You can carry or place somewhere accessible a “Know Your Rights” card that states: “I want to remain silent. I want to speak to a lawyer.” You can hand it to officers if approached. See an example here.
  • The State of California and many Bay Area cities have “sanctuary” or non-cooperation policies which mean local law enforcement may limit cooperation with ICE. This can give you somewhat more protection locally (though it doesn’t guarantee immunity from federal action).
